Cybercrime Incidents Of 2017

 

 "A few bank accounts were reported to have been emptied during October. The only common thing among the victims was that they had ordered the pizza a few days before. This “sherlock holmes” riddle was resolved when Pizza Hut sent an email to its customers admitting that their website and apps had been hacked for 28 hours and customer data, including personal and payment information data, had been leaked. Over 60.000 customers were affected. The direct and indirect cost caused to the company on attending customer calls, insurance impacts or loss of reputation, has not been publicly exposed. But it must have definitely been a significant bite."




 According to Josh and Donovan (2017),  Pizza Hut Company was hacked by the hackers in which involved 60,000 customers around the U.S. The majority of the customers are those who place the order using the website or mobile apps on 1st and 2nd October 2017. The company reported that their customer's personal information such as name, delivery address, payment card information and billing ZIP code was leaked out. This issue becomes serious because Pizza Hut informed their customers 2 weeks after the incident happened that leads to the worst when some of their customers account were empty. The hackers hacked Pizza Hut by using Pizza Hut identity and asked the customer's personal information through email. According to the law, Pizza Hut has right to makes a late announcement to the affected customers in order to prevent other hackers attacked and notified about a security breach that happens to their company.


Let’s refer back to Computer Crime Act 1997, initially, the hacker had the intention of accessing Pizza Hut website by using admin’s account identity which falls under unauthorized access. However, the unauthorized access caused the hacker is guilty under Section 3 and Section 5. This case can fall under unauthorized access to computer material for the hacker as they have the intention to access a secure website with someone else’s account identity. Not only that, the intention of the hacker was to commit an offence of accessing personal data of Pizza Hut’s customer. On section 5, the hackers know that they had the intention of breaching the data and make some modification of the customer’s personal data. This can be seen from the response of the customer whereby their personal information inside Pizza Hut website has gone. Thus, the hackers have committed an unauthorized access and modification to Pizza Hut website.

The mens rea can be clearly defined in this case as the hacker have the intention to hack the Pizza Hut system by using their knowledge which is specific hacking coding. It is can be seen that the hacker have the motif to hack Pizza Hut system in which they steal the customer personal information in order to have access in customer's bank account. That statement can prove that the hacker must have made plans first before hacked the Pizza Hut website and apps. Besides, the hacker using their knowledge to commit wrongful acts which are hacking the Pizza Hut system in order to steal the customer’s personal information. In addition, the wrongful acts that commit by the hacker known as an actus reus in which fall under section 3 which is unauthorized access to computer material.
